1. Acceptance of Terms
By accessing or using the services provided by Hooper's Tire Outlet ("we," "us," "our"), including our website, retail locations, and SMS messaging program, you agree to these Terms of Service. If you do not agree, please do not use our services.
2. SMS Messaging Program
Program Description: Hooper's Tire Outlet provides automated and manual SMS alerts regarding service appointments, tire availability, and order status updates. This SMS program does not send promotional, marketing, or sales messages.
Message Types You May Receive:
- Appointment confirmations and reminders
- Service status updates and vehicle-ready notifications
- Responses to missed calls and customer inquiries
- Post-service follow-up and review requests
Message and data rates may apply. Message frequency varies based on your service activity. Reply STOP to opt out at any time. Reply HELP for assistance, or call (585) 773-4335.
Data Sharing: We do not share or sell mobile opt-in data or consent information with any third parties for marketing purposes. Mobile phone numbers and SMS/text messaging opt-in consent data are expressly excluded from all third-party sharing for marketing purposes.
Consent Is Not a Condition of Purchase: You may use our services and purchase products without opting in to SMS communications.
3. Age Restriction
The Hooper's Tire Outlet SMS program is intended for individuals 18 years of age or older. By opting in, you confirm that you are at least 18 years old. We do not knowingly collect information from minors.
4. Carrier Liability Disclaimer
Wireless carriers are not liable for delayed or undelivered messages. Message delivery is not guaranteed. Hooper's Tire Outlet is not responsible for issues caused by carrier networks, message blocking, or device-specific limitations.
5. Tire Warranty & Service Terms
50,000 Mile Treadwear Warranty: All tires purchased from Hooper's Tire Outlet come with a 50,000 mile treadwear warranty. To maintain coverage:
- Tires must be rotated every 6,000 miles from the date of purchase
- Customer must provide proof of rotation
- Tires must not exhibit uneven wear caused by alignment, suspension, or driving conditions
Warranty claims are evaluated on a case-by-case basis. Refunds and replacements are at the sole discretion of Hooper's Tire Outlet management.
6. Service Appointments
Customers may schedule service appointments by phone, in person, or via our website. We reserve the right to reschedule appointments due to parts availability, equipment issues, or unforeseen circumstances. Customers will be notified promptly of any changes.
7. Limitation of Liability
To the maximum extent permitted by law, Hooper's Tire Outlet is not liable for incidental, consequential, or indirect damages arising from the use of our services, including but not limited to lost profits, vehicle downtime, or third-party charges.
8. Modifications to Terms
We reserve the right to modify these Terms of Service at any time. Changes are effective upon posting to legal.hooperstireoutlet.com/terms. Continued use of our services after changes are posted constitutes acceptance of the updated terms.
9. Governing Law
These Terms of Service are governed by the laws of the State of New York, United States. Any disputes shall be resolved in the courts of Monroe County or Onondaga County, New York.
